These General Terms and Conditions of Sale (“Conditions”) govern the purchase of products through the e-commerce Site operated by BRUFIT SRL, with registered office at Corso Canale 14, 12051 Alba (CN), VAT no. IT 12676760015 (hereinafter “BRUFIT” or the “Seller”).
By placing an order on the Site, the Customer declares that they have read, understood and accepted these Conditions.
1. Subject of the contract
The contract concerns the sale of products offered by BRUFIT through the Site. The main characteristics of the products are described in the relevant product pages, which the Customer must consult before purchasing.
2. Prices and availability
Prices shown on the Site are expressed in Euro and, unless otherwise stated, include VAT. Shipping costs and any additional charges are indicated separately before the order is confirmed.
Product availability is shown on the Site and may vary in real time; in the event of subsequent unavailability, BRUFIT will inform the Customer and may offer a refund or replacement with a similar product.
3. Formation of the contract
The order submitted by the Customer through the Site constitutes a contractual offer. The contract is deemed concluded when the Customer receives an order confirmation e-mail from BRUFIT containing a summary of the products purchased, prices and applicable conditions.
4. Methods of payment
The payment methods available (e.g. credit card, PayPal, bank transfer, cash on delivery, etc.) are indicated on the Site during checkout. The Customer undertakes to use only payment instruments that they lawfully own. Data relating to electronic payments are processed by specialised third-party providers (payment gateways) and are not stored by BRUFIT.
5. Shipment and delivery
The methods, costs and times of delivery are governed by the Shipping Policy, which forms an integral part of these Conditions.
6. Right of withdrawal and returns
The arrangements and conditions for exercising the right of withdrawal are set out in the Return Policy, which also forms an integral part of these Conditions.
7. Legal guarantee of conformity
Products are covered by the legal guarantee of conformity provided for by the Italian Consumer Code. In the event of a lack of conformity, the consumer Customer is entitled, under the conditions laid down by law, to have the product brought into conformity, to a price reduction or to termination of the contract. For any request for assistance under guarantee, the Customer must contact BRUFIT using the contact details shown on the Site and provide proof of purchase.
8. Limitation of liability
Except in cases of wilful misconduct or gross negligence, BRUFIT’s liability for any damage connected with the purchase or use of the products shall not exceed the total price paid by the Customer for the products concerned.
9. Governing law and jurisdiction
These Conditions are governed by Italian law.
For disputes with consumers, the court of the Customer’s place of residence or domicile shall have jurisdiction. For Customers who are not consumers (professionals, businesses, VAT-registered entities), jurisdiction shall lie exclusively with the court where BRUFIT has its registered office.
10. Amendments to the Conditions
BRUFIT reserves the right to amend these Conditions at any time. The updated Conditions will apply to sales concluded after their publication on the Site.
